Terms of Use

Version 2026-11 · in force from 1 November 2026

This is Part B of the document every pharmacy accepts in ScriptDesk. The Privacy Policy (Part A) is on its own page.

Introduction

ScriptDesk is pharmacy management software made for retail pharmacies in India. It keeps a pharmacy's stock, bills, customers, suppliers, registers and accounts on the pharmacy's own computer, and it can connect to the ScriptDesk cloud, a service run by the publisher of ScriptDesk ("we", "us") that provides licences, software updates and announcements.

This document has two parts. Part A, the Privacy Policy, explains what information ScriptDesk handles, where it is kept, what leaves the pharmacy's computer and why, and the rights of the people the information is about. Part B, the Terms of Use, sets out the agreement between the pharmacy that uses ScriptDesk ("you") and us.

Please read both parts carefully. By creating a store in ScriptDesk, ticking the box that says you agree, or using ScriptDesk, you accept this Privacy Policy and these Terms of Use on behalf of your pharmacy. If you do not agree, do not use ScriptDesk. The version in force is shown at the end of this document; the version you accepted, and when, is shown in ScriptDesk under Settings, About.

13. Who may use ScriptDesk

ScriptDesk is for pharmacies and medical stores that hold a valid licence to sell drugs in India. The person who creates the store must be at least eighteen years old and authorised to accept these terms on behalf of the pharmacy. You confirm that the details you give about your store are true and that you will keep them up to date.

14. Your licence to use ScriptDesk

Subject to these terms and to paying any fee that applies, we grant your pharmacy a non-exclusive, non-transferable licence to install and use ScriptDesk for the running of your own pharmacy, on the number of computers your plan allows, for as long as your licence is in force. You may make backup copies of your own data.

You may not sell, rent, sub-license or share ScriptDesk with another business; copy, modify or create works based on it; reverse engineer, decompile or disassemble it except as the law expressly allows; remove notices of ownership; get round its licence or security measures; or use it for anything unlawful, including the sale of drugs without a valid prescription where one is required.

15. Trials, plans and fees

We may offer a free trial for a limited period. After the trial, or when a paid licence ends, continued use of the features that need a licence requires a paid plan. The plan, its price, the number of computers it covers, how it is paid and when it renews are as agreed when you buy it. Prices are exclusive of GST, which is added as the law requires.

If a fee is not paid when due, we may, after giving notice in ScriptDesk, limit ScriptDesk to viewing and printing your existing records until it is paid. We will never delete your records or stop you from exporting them because of an unpaid fee. Fees already paid are not refundable except where the law requires or we agree otherwise in writing.

16. Logins and the people who use ScriptDesk

You are responsible for everything done in ScriptDesk under your store's logins. Give each member of staff their own login, keep passwords private, remove the logins of people who leave, and keep the recovery key in a safe place. Tell us at once if you think someone has used your store's connection to the ScriptDesk cloud without permission.

17. Professional responsibility stays with the pharmacist

ScriptDesk is a tool for keeping records and running a pharmacy. It does not give medical, pharmaceutical, legal or tax advice, and it does not replace the professional judgement of the registered pharmacist.

Counselling suggestions, refill reminders, order suggestions, readings of pack photos and every other figure or suggestion ScriptDesk shows are aids. Check them before you rely on them. You remain responsible for dispensing only against a valid prescription where the law requires one, for the medicine, batch, expiry and quantity you supply, for the counselling you give, for the registers and records the law requires, and for complying with the Drugs and Cosmetics Act, 1940, the Drugs Rules, 1945, the Pharmacy Act, 1948, and the Pharmacy Practice Regulations, 2015.

18. Tax, GST and accounts

The GST working, purchase register, profit report, day's cash and other financial reports are prepared from the records you enter, to help you and your accountant. They are not tax advice and not a filed return. Their accuracy depends on what is entered: for example, input credit appears only for purchase bills entered in ScriptDesk. Check them with a qualified accountant. You remain responsible for your tax invoices, returns, payments and records under the Goods and Services Tax laws.

19. Your data belongs to you

The records you keep in ScriptDesk belong to your pharmacy. You may export them, back them up and take them with you at any time. You give us permission to receive and use the information described in section 4 to provide the ScriptDesk cloud to you, and to use it in combined form that identifies no pharmacy and no person, as described in section 5.

Keeping backups is your responsibility. ScriptDesk makes daily copies on your computer and can place a copy on a pen drive or in a cloud folder you choose, but we cannot recover records lost from your computer if you have no copy.

20. Updates, announcements and changes to ScriptDesk

We may release new versions of ScriptDesk that add, change or remove features. Updates are offered in ScriptDesk and are installed only when you choose. Some features, including the ScriptDesk cloud, may require a recent version.

ScriptDesk may show announcements, news and offers from us or our partners in the box on its dashboard. They are chosen by us, never use your customers' information, and do not mean that we endorse a product unless they say so.

21. Services from others

Some features use services provided by others under their own terms: hosting of the ScriptDesk cloud, Anthropic's Claude for AI reading, WhatsApp for messages, Google Drive, OneDrive or similar services for copies, and Windows for camera and location. We are not responsible for those services, and using them may require your own account with the provider.

22. Availability

The parts of ScriptDesk that work on your computer do not depend on the internet. The ScriptDesk cloud is provided with reasonable care and skill, but we do not promise that it will always be available or free of errors; it may be interrupted for maintenance or by events beyond our control. If it is unavailable, ScriptDesk continues to work and reports again later.

23. Ownership of ScriptDesk

ScriptDesk, its design, code, documentation, the ScriptDesk name and logo, and the starter medicine list remain the property of the publisher and its licensors. These terms give you a licence to use them; they do not transfer ownership. ScriptDesk includes open-source components, such as the ZXing barcode reader used on the browser link, which are provided under their own licences.

24. Warranties

We will provide ScriptDesk with reasonable care and skill. Apart from that and from anything the law does not allow us to exclude, ScriptDesk is provided "as is" and "as available", without any other promise — for example, that it will meet every need of your pharmacy, work with every computer or device, or be free of every error.

25. Limits on liability

Nothing in these terms limits liability that the law does not allow to be limited, such as liability for fraud.

Subject to that, we are not liable for loss of profit, business, goodwill or data, or for any indirect or consequential loss, arising from the use of ScriptDesk or the ScriptDesk cloud; nor for loss caused by decisions taken without the checks described in sections 17 and 18, by failure to keep backups, by the actions of people using your logins, or by services provided by others. Our total liability to your pharmacy for all claims arising from ScriptDesk in any twelve months is limited to the fees your pharmacy paid us for ScriptDesk in the twelve months before the claim arose.

26. Your promise to us

You agree to compensate us for any claim, loss or penalty that arises because your pharmacy used ScriptDesk unlawfully, broke these terms, or processed the personal data of customers, patients or staff in breach of the law.

27. Suspension and ending

You may stop using ScriptDesk, and disconnect it from the ScriptDesk cloud, at any time. We may suspend or end your licence, after notice where reasonable, if your pharmacy seriously breaks these terms, uses ScriptDesk unlawfully, loses its drug licence, or does not pay fees that are due. When a licence ends, your records remain on your computer and you can still open, print and export them; sections 17 to 19 and 23 to 28 continue to apply.

28. Law and disputes

These terms and this policy are governed by the laws of India. Before going to court, both of us will try in good faith to settle any dispute by discussion for at least thirty days. Disputes that cannot be settled will be decided by the courts having jurisdiction over the place of the publisher's registered office in India.

29. Changes to these terms, and general points

We may change these terms when ScriptDesk or the law changes. When a change matters, ScriptDesk will tell you and ask you to accept the new version; if you do not accept it, you may stop using the features that need a licence, and we will not charge you for them after that.

If any part of these terms is found to be unenforceable, the rest remains in force. If we do not enforce a term at once, we may still enforce it later. You may not transfer your licence without our written agreement. These terms, with the plan you bought, are the whole agreement between your pharmacy and us about ScriptDesk.

30. Contact

For questions about this policy or these terms, to exercise your rights, or to raise a grievance, write to the publisher of ScriptDesk at info@scriptdesk.in. Please include your store's name and the mobile number registered with it, so that we can find your records.
